The city of Miami Beach is the latest in what can only be described as a hurricane of lawsuits. Last month, the residents of the popular vacation spot suffered a devastating storm named Memorial Hurricane Matthew. Matthew’s mammoth rainfall was the biggest to hit South Florida since Hurricane Wilma in 2021. At the time, most people stuck without electricity and with no way to communicate with anyone else on the mainland or those on their islands. While Sun City Hilton Head locals involved in a massive years-long class-action lawsuit against the developer of the beachfront luxury resort failed to get any real resolution in court, they did manage to put a few well-placed sunscreen cans to good use. This week, the Miami-Dade county Public Defender’s Office is expected to announce that it will be reviewing the case for dismissal.

Stucco Lawsuit

Although Sun City Hilton Head’s hurricane was undeniably one of the worst to hit the South Florida area in recent history, homeowners in the area are also filing similar lawsuits in anticipation of coming storms. It shouldn’t be too difficult for the legal professionals representing the plaintiffs in these cases to admit that many cases of this type will simply be resubmitted to the courtroom every time a big storm hits the area. Why is that? Simply because building owners and builder contractors don’t want to take the risk of having to go to court over water damage problems that could easily be resolved through a simple certification and agreement process with their insurance companies.

Homebuilders are hardly the only group of people who will experience some kind of water damage problem in Florida.

It’s simply too expensive for insurance companies to pay thousands of dollars in claims just because a homeowner or builder altered or built a house despite faulty workmanship.
